Serving God and the State
Marriage is by a State's definition a legal contract with each State requiring a license for a marriage to be legally contracted. The marriage can only be terminated by the legal process of divorce by a coutaks decree. Each State has its own defined requirements for both marriage and divorce. The States also establish the requirements as to who may act on behalf of the State as its agent by license or authorization.
Marriage is also defined by those churches who live into the catholic tradition as sacrament. For other denominations marriage is seen as a Holy Covenant mentioned by Christ in the Gospels as a relationship between a man and woman.
The decision of the Supreme Court of California regarding the legal right of persons of the same sex to marry is a matter of importance because it affirms equal protection under the law and affirms the right of all persons to have the right to engage in the legal right to marry, regardless of their sexual orientation or identity. It does not carry the weight or involvement of a religious action or initiative.
Each religious tradition or denomination usually has its own laws or customs as to who may be married by its clergy. No clergy person is forced or required to marry any person who comes to them seeking to be married.
The real issue here is the unfortunate duality that exists in the United States where clergy may act as both agents of the State, licensed to perform a marriage on behalf of the State and who are also charged with living into the laws and traditions of their religious traditions. They may or may not witness and bless marriage as either a sacrament of the church or a clear mandate of Christ's teaching about marriage as delivered through the Gospels.

Bingo Rev. Chane!
The question is, how many more of today's clergy understand that to untangle their religion from the civil affairs of the State is to free them to exercise religious liberty in accordance with our Constitution, completely unrestrained by the State?
And how many clergy will choose pure religious liberty over their current privileged status which is dependent on continued entaglement with the State?

What it says to me is that clergy ought to tell their 'flocks' what it means to be a licensed agent of the state to perform marriages, rather than promoting the misapprehension that it's the other way around when it comes to civil law.
I've served at enough weddings myself that the happy couple hardly needs more bureaucracy to deal with, but as clergy, no, it's no church's place to tell the *state* what to do or who can get legally-married.
Seems a lot of Christians are unclear on this point.
Let's just be clear on that, let the state grant equal protection under the law to any who sign said contract, and get on with life.
